MiDispensary asks TGA to withdraw advertising fines

The Australian Institute of Medicinal Cannabis has written to the Therapeutic Goods Administration (TGA) asking it to withdraw fines of more than A$100,000 issued late last year.

The company's clinic arm, MiDispensary, was hit with eight infringement notices totalling $106,560 in October 2022 for the alleged unlawful advertising of medicinal cannabis products on its website and social media channels.

At the time, MiDispensary founder and managing director Eidan Havas said he had hired an independent regulatory compliance officer to conduct an audit and make any necessary changes after receiving a warning from the regulator in March.

Despite these efforts, fines were still forthcoming.

MiDispensary's legal counsel has now written to the TGA outlining the steps the firm took to rectify the alleged breaches and urging the regulator to exercise discretion.

The letter states: "At all times since the warning, our client's actions have reflected a business concerned with achieving compliance with the Australian regulatory framework."

The firm is awaiting a response from the TGA.
