TGA Opens Stakeholder Survey to Shape FY24 Compliance Focus

The Therapeutic Goods Administration (TGA) has released a stakeholder survey to guide its compliance priorities for FY24, following its decision to flag medicinal cannabis advertising as a key focus area in the current financial year.

The survey invites participants to highlight "the most concerning non-compliance trends or issues relating to therapeutic goods" observed throughout CY22.

Respondents are asked to describe the non-compliant conduct in question, outline the actual and potential harms involved, indicate how frequently it was observed, and note whether it has become more or less prevalent compared with prior years.

The survey also seeks input on the TGA's FY23 priorities, including its efforts to ensure the medicinal cannabis industry meets its obligations and whether those concerns remain ongoing.

Throughout FY23, the regulator has handed down a series of fines for alleged advertising breaches in the medicinal cannabis sector, with Little Green Pharma, Cannatrek, MGC Pharmaceuticals, MiDispensary and CA Clinics among the companies penalised.

Additionally, last month saw the launch of a new website designed to make it easier for people to report allegations of unethical conduct within the Australian medicinal cannabis industry to relevant authorities.

Submissions should be directed to the TGA's regulatory compliance branch — rc*********************@********ov.au — by close of business on Monday April 3.
