WA Legalise Cannabis MP Tables Bill Allowing Adults to Grow and Possess for Personal Use

Legalise Cannabis Western Australia MP Dr Brian Walker has introduced legislation that would permit adults to cultivate up to six cannabis plants at home, hold up to 50 grams for personal use, and gift up to 50 grams to another person.

The Misuse of Drugs (Lawful Personal Use of Cannabis) Amendment Bill 2026 was brought before the WA Legislative Council last week. If passed, it would amend existing legislation to effectively decriminalise personal cannabis use among adults.

Under the proposed changes, public consumption and commercial sale would still be banned, and outstanding adult cannabis infringement notices would no longer remain in force.

Walker — a general practitioner with 46 years of experience — said the legislation was aimed at stopping the criminalisation of ordinary West Australians.

“This bill is about common sense,” Walker said. “It’s about treating adults as adults, freeing up police resources, and ending the criminalisation of everyday Western Australians for a plant that is legal in jurisdictions across the globe.”

The party said the bill was designed to work alongside the existing medicinal cannabis scheme rather than replace it.

“Right now, medicinal cannabis patients pay hundreds of dollars a month for products their GP wants to prescribe,” the party said.

“This bill would allow any adult to grow their own – meaning patients who can’t afford the pharmacy have another option. It doesn’t replace medical supervision. It removes a barrier.”
